Minimum wage in Spain is 1,108,33 Euros per month
Maximum normal working hours are 40 hours per week.
Workers who work for 24 hours or more a month for the same employer are entitled to annual leave.
Every worker is entitled to 21 consecutive days annual leave on full pay in every leave cycle. This equates to 15 working days per annum if the employee works a five-day week, and 18 working days per annum if the employee works a six-day week.
The first 3 days of sick leave are unpaid.
From day 4 to day 20 of the sick leave the employee is entitled to 60% of the contribution base.
From day 21 on of sick leave the employee is entitled to 75% of the contribution base.
In order to receive support, you will need a medical examination and that a doctor from the Servicio Público de Salud (State Health Services) certifies your illness.
The total duration of maternity leave is 16 consecutive weeks in which six weeks are mandatory and must be taken after the birth, while the remaining ten weeks can be taken before or after the birth. In the case of multiple births, 2 weeks for each son or daughter from the second.
The qualifying conditions to be entitled to maternity benefits are determined both by the worker’s age and the duration of her contribution to the general social security scheme.
a) if the worker is under 21 years of age on the date of birth: a minimum contribution period is required.
b) If the worker is between 21 and 26 years old: a minimum contribution period of 90 days is required in the 7 years immediately prior to the start of the leave or, alternatively, 180 days of contribution during the entire working life of the worker before the date.
c) if the worker is over 26 years old: a minimum contribution period of 180 days is required in the 7 years immediately prior to the time the leave starts or, alternatively, 360 days in the worker’s entire working life before of the date.
To be entitled to receive maternity benefits, employees must be affiliated with the general social security scheme and have made contributions for 180 days in the 5 years prior to the date of birth
Fathers are entitled to 16 weeks of paternity leave.
In case of a dismissal for economic or individual reasons, it is necessary to observe a notice period of 15 days between the termination letter and the effective termination of the employee. During this period, the employee has the right to paid leave of 6 hours per week to search for a new job. However, the employer can choose to pay an indemnity in lieu of notice, equal to the salary of those 15 days.
For example, if the employee’s dismissal is notified 5 days before the termination of his or her contract, the employer will have the obligation to pay the corresponding indemnity in lieu of notice plus 10 days of salary in the final settlement agreement.
In case of a dismissal for serious cause, a notice period is not mandatory.
In Spain, employment law recognizes the possibility of arranging, in writing, a probation period that should be subject to the term limits negotiated with the workers’ representative. If no agreement is reached between the parties or with the workers’ representative, the legislation lays down the following limits that should be respected in all cases: ideally lower than or equal to 6 months.
The standard VAT rate is 21%.
